DEFINITIONS AND INTERPRETATION

In these Terms & Conditions, unless the context otherwise requires, the following expressions have the following meanings:

“We/Us/Our” means Brighton & Hove Streamline Limited, trading as “Streamline Taxis”, company number 03258868, registered in England, VAT number 938 6390 81

“Customer” means the person or legal entity ordering a taxi

“Service” means the service we provide of acting as agents to supply self-employed taxi drivers with bookings from customers requiring a licensed taxi cab.

“Taxi” means a hackney or private hire vehicle, licensed by Brighton & Hove City Council, operated by a self-employed driver, which will be dispatched to the customer

“Taxi driver” means the self-employed driver of the taxi

“Contract” we act as agents for the taxi drivers, as such any contract is between the customer and the taxi operator.

“City” means the city of Brighton & Hove, East Sussex.

INFORMATION ABOUT US

Brighton and Hove Streamline Limited is a Private Limited Company registered at Companies House under 03258868, our registered office and trading address is 5 Clifton Hill, Brighton, East Sussex BN1 3HL. The company trades as “Streamline Taxis”

We act as an Association of self-employed taxi drivers, all of whom are fully insured, DBS checked and meet the high standards set by Brighton & Hove City Council to operate as taxi drivers.

BOOKING OF SERVICES

A taxi may be booked by telephone, 01273 202020, Mobile App, or via the internet www.streamlinetaxis.org

Any collection or booking time we may give or agree with the customer is only an estimate and should not be relied upon. Whilst we will endeavour to meet the customer’s requirements this may not always be possible due to circumstances beyond our control, such as but without limiting the generality of the foregoing, traffic, roadworks, weather conditions, excess demand, and we do not accept liability for any direct or consequential loss the customer may suffer as a result of failure to meet a booking time.

FARES

Prices for journeys within the city are metered, with the mileage and waiting time based on the prevailing Hackney Carriage tariffs. Whilst an estimate of the expected fare can be provided when the customer makes the booking, this price cannot be guaranteed as the length of the actual journey will depend on prevailing road conditions at the time.

Surcharges apply for multi-seater vehicles, excessive luggage, journeys taken between 11p.m. and 7 a.m. and journeys on Christmas Day. The cost of these surcharges will be made clear at the time of booking.

Fares for journeys outside the city will be agreed at the time of booking.

Fixed fares are available for journeys to and from airports. Flight arrival times are checked prior to the taxi being dispatched for airport pickups, however, if the passenger takes longer than one hour to emerge from arrivals the driver will charge additional waiting time, currently £20 per hour or part thereof.

Fares for undertaking deliveries or removals or the carrying of unusual items must be paid in advance with the fare agreed at time of booking. Any such items are transported entirely at the customers risk and neither we nor the taxi drivers accept any liability for loss or damage.

NB Our Taxi drivers will not transport items which are radioactive, toxic, inflammable noxious or otherwise of an inherently dangerous nature

PAYMENT FOR SERVICES

For journeys within the city the passenger will pay the taxi driver by cash or credit/debit card

Customers are required to pay at the time of booking for any journeys outside the city. In the event of the passenger not being at the agreed pick up point at the agreed time the customer will be liable for an additional charge for waiting time and parking charges where applicable. The customer will pay these additional costs directly to the taxi driver at point of pick up.

The company acts as agents for the taxi drivers, so the fare is due to them in its entirety, as such there is no VAT on the fares charged as none of the taxi operators are registered for VAT.

Cheque (must be cleared before the journey booked is undertaken)

CANCELLATIONS

A customer may cancel a booking within the city up to 5 minutes before the agreed pick up time. For out of city or airport bookings a customer must cancel within 3 hours of the agreed pick up time.

REFUNDS

Where we have taken advance payment for a booking and the customer cancels within the time limit specified in these terms and conditions we will make a full refund.

For cancellations outside the limit specified within these terms and conditions an application for a refund must be made in writing and any refund will be made entirely at our discretion.

CUSTOMERS

Customers must inform us at the time of booking if they wish to transport domestic animals. Dogs must be on a lead or harness and other animals contained in a suitable carry box or cage.

It is a legal requirement to transport assistance dogs wearing a designated harness, however, in the interests of avoiding delay customers should inform us at the time of booking if they are using an assistance dog as a few taxi drivers suffer extreme allergies and are thus certified exempt from transporting assistance dogs.

Customers are not permitted to smoke, including e-cigarettes, or consume food or alcohol in the taxi.

Taxi drivers may refuse to transport a customer they believe to be intoxicated.

Customers who vomit or otherwise soil a taxi must pay a cleaning fee, currently £120.

Customers are responsible for their own possessions and luggage; we take no responsibility for any loss or damage caused by customers failing to remove their possessions at their destination. Taxi drivers are required to hand over any lost property to the local police station.

COMPLAINTS

If a customer has a complaint regarding our staff or taxi drivers we ask that these be made in writing and addressed to the company at 5 Clifton Hill, Brighton, BN1 3HL. All taxis dispatched have CCTV and vehicle tracking which may be used in the investigation of a complaint.

PERSONAL INFORMATION

All personal information that we may use will be collected, processed and held in accordance with the provisions of the EU Regulation 2016/679 General Data Protection Regulation, (GDPR).

GOVERNING LAW AND JURISDICTION

If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority those provisions shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.

These Terms and Conditions and your relationship with us and our self-employed Taxi Drivers shall be governed by and construed in accordance with English Law.

We may alter these terms and conditions at any time, any such changes will become binding from the time they are uploaded to our website www.streamlinetaxis.org as such you are advised to regularly visit the website to remain up to date.

FRAUD

“Furthermore, we hereby inform you, in connection with your order, of the use of the "Fraud Expert" solution in addition to the processing of card not present payments. Your personal data is processed by Ingenico e-Commerce Solutions SPRL being the controller, for the purpose of preventing and combating fraud (determining risk levels associated with transactions, detecting and managing any resulting alerts, informing merchants to allow them to take decisions, "human" reviews of transactions with a specified level of risk, modelling of the score).

The collection of certain of your personal data is a mandatory requirement for this purpose.  Without this data, your transaction could be delayed or rendered impossible and your order cancelled. This data is intended for the authorised departments of the Ingenico e-Commerce Solutions entities involved in such processing, and for the merchant, as well as for any third party whose involvement is required to ensure the smooth operation of the payment process and the functioning of the services offered”.

“Furthermore, a fraud may give rise to the recording of certain personal data relating to you in a dedicated file managed by Ingenico e-Commerce Solutions SPRL. The purpose of such file is to retain a trace of previous frauds, in particular to provide information for criteria used to evaluate transaction risks and the scoring templates used for this purpose. 

The recording of your data in this file may also lead to you being assigned a higher risk level in the event of any subsequent order placed with a merchantthat is active in the same type of industry/sector and that is using the Fraud Expert solution, and consequently could potentially lead to the rejection of this order.

According to the provisions on the protection of personal data, you have the right with respect to the Fraud Expert solution to query, access and correct your data, as well as the right to object, for a legitimate reason, to this processing of your data.
